Calling someone a rat constitutes defamation

The Supreme Court Thursday upheld the conviction of a man for defaming a conservative scholar by describing him as a rat.

In December 2008, the accused threw eggs at a photo of Professor Ahn Byeong-jik of Seoul National University with about 10 journalists and other civic activists watching. Ahn was then head of the New Right and created a stir by teaching in his classes that the 1910-45 Japanese colonial rule contributed to Korea’s modernization.

Days later, the man posted an article on a website in which he denounced Ahn, referring to him as a rat. Progressive activists have also described President Lee Myung-bak as a rat to ridicule him.

Ahn accused the man of defamation. In the first and second trials, he was fined 1 million won ($920) for defamation by using the rat description. Throwing eggs was not an act of defamation, the courts said.

The top court’s ruling came weeks after a lecturer was sentenced to 2 million won in fines for tarnishing the nation’s image by painting a rat on the G20 Seoul Summit promotional posters last year.

뉴라이트 인사 '쥐' 비유 30대 유죄 확정

대법원 2부(주심 이상훈 대법관)는 26일 뉴라이트재단 이사장을 '쥐'에 비유하고, 사진에 계란을 던진 혐의(모욕)로 기소된 학원 강사 안모(39)씨에 대해 사진에 계란을 던진 혐의는 무죄로 판단, 벌금 100만원의 선고를 유예한 원심 판결을 확정했다.

안씨는 2008년 12월 인터넷 다음 사이트 카페에 '내일 12일 안병직(뉴라이트재단 이사장·서울대 명예교수)이 서서울 생활과학고에 나타납니다. 쥐 잡으러 갑시다.'라는 제목의 글을 올리는 등 두 차례에 걸쳐 안씨를 '쥐'로 표현, 모욕한 혐의로 기소됐다.

안씨는 또 같은 달 서울시내 한 고등학교 앞 도로에서 인터넷 카페 회원과 기자 등이 모여있는 자리에서 안씨의 사진에 계란을 던져 모욕한 혐의로도 기소됐다.

하지만 1, 2심은 계란을 던진 것만으로는 모욕죄를 적용할 수 없다며 이 부분 무죄를 선고하고, 나머지만 유죄로 판단해 선고유예 판결을 내렸다.
