Riding Motor Bike With Physical Strength Not Drunken Driving

The court Monday ruled that it cannot be seen as driving under influence if a driver moves a motor bike physically means without turning the engine on.

A 39-year-old man filed a suit against the Seoul Metropolitan Police Agency calling for the withdrawal of the cancellation of his driver's license. The police terminated his license as his blood alcohol level was over 0.1 percent in a test.

But he claimed the cancellation was not fair as he did not ``drive'' a motorbike but was simply moving it with his legs when seated on it.

``Under the current law, driving should involve turning an engine on and moving a vehicle with the power of the engine,'' a judge said in the ruling.
