Samsung bites back at Apple with lawsuit

Fighting talk is flying left and right between Samsung Electronics and Apple over the ingenuity of their mobile gadgets as the technology sector braces for its next patent battle.

Just days after Apple filed a patent infringement suit against Samsung, accusing the company of "slavishly" copying the look and feel of the immensely-popular iPhones and iPads, Samsung fired back Friday with its own lawsuit.

Samsung's lawsuits against Apple were filed simultaneously in Korea, Japan and Germany, with the Korean firm accusing its rival of using some of its patented technologies without consent in designing the latest iPhones and iPads.

Samsung's complaint filed with the Seoul Central District Court claimed infringement of five of its patents, while the lawsuits in Tokyo and Mannheim involved two and three patents, respectively.

The technologies are related to wireless connectivity, data transmissions and power controls, company officials said.

"Samsung is responding actively to the legal action taken against us in order to protect our intellectual property and to ensure our continued innovation and growth in the mobile communications business," the company said in a statement.

Apple filed its lawsuit against Samsung last week with the U.S. district court of Northern California.

While the former is complaining of the latter mimicking the design of the hardware and on-screen icons of its products, Samsung's lawsuit is based on issues related to technology, company officials said.

They declined to talk about the size of compensation the company is seeking from Apple.

"Apple stole handset transmission technologies such as high-speed packet access (HSPA), wide-band code division multiple access (WCDMA) and mobile data sending technologies used in the Apple devices," said a high-ranking Samsung executive, who refused to be named.

Steve Park, Apple's local representative, declined to comment.

The lawsuit came just a day after Samsung Chairman Lee Kun-hee accused Apple of unjustly attempting to hold Samsung back.

"Maybe that's the logic that when a nail sticks out, then (people) try to pound it down,’’ Lee told reporters.

Tim Cook, Apple's chief operating officer (COO) and the top confidant of CEO Steve Jobs, insisted that Samsung's telecommunication division "crossed a line."

"I think the battle with top-tier electronics companies is mostly due to the rapid rises of Samsung's 'smart' devices and the increasing `bargaining power’ of the Android community," said Seo Won-suk, an analyst from NH Investment, a local stock research firm.

It bears further watching whether the legal action will prove as a stress test for the delicate bond between the two technology giants, which have been foes in finished products but friends in parts.

Samsung is the latest among a growing list of technology companies to become entangled in Apple's web of litigation.

Nokia, Motorola and HTC are embroiled in legal battles with Apple over technologies related to smartphones and software.

The lawsuits trickle beyond electronics makers, as Apple has sued or has been sued by Microsoft, Amazon and Eastman Kodak over a variety of products and services.

Industry observers say that Apple’s lawsuit against Samsung displays the company's growing uneasiness about its strengths in mobile devices and online content stores beginning to be duplicated by gadgets that run on Google's Android mobile operating system.

Samsung, along with other handset vendors like Motorola, HTC, and Sony-Ericsson, are flooding the market with Android smartphones that are shaping up as rivals to the iPhone.

And in the nascent market for tablets, Samsung’s Android-based Galaxy Tabs have been providing the only meaningful competition to Apple's iPads.

Steve Jobs jabbed at Samsung when introducing the latest version of the iPad last month, saying in a slide presentation that the company was among competing tablet makers that will make 2011 the "Year of the Copycats."

삼성, ``애플이 특허기술 10건 침해’’

삼성전자가 애플을 맞고소 했다.

삼성전자는 21일 서울중앙지방법원에 애플코리아를 상대로 특허침해금지 및 손해배상 청구 소송을 제기했다고 밝혔다.

더불어 일본 도쿄법원과 독일 맨하임법원에도 애플의 특허침해에 관해 제소했다.

삼성이 제소한 특허는 한국 5건, 일본 2건, 독일 3건 등 총 10건이다. 삼성측은 ``대상제품은 애플의 아이폰과 아이패드’’라고 밝혔다.

삼성은 이날 보도자료를 내고 ``데이터 전송시 전력소모는 감소시키고 전송효율을 높이는 고속패킷전송방식 (HSPA), 통신표준 특허, 데이터 전송시 수신오류를 감소시키는 WCDMA 통신표준 특허, 휴대폰을 데이터케이블로 PC와 연결해 PC로 무선 데이터통신을 가능케 하는 특허등을 애플이 침해했다’’고 주장했다.

삼성의 이와 같은 ``맞짱’’ 의지는 이건희 삼성전자 회장이 애플이 자사에 제기한 소송과 관련 ``못이 튀어나오면 때리려는 원리’’ 라고 언급한 지 단 하루 만에 전격적으로 이뤄진 조치다.

그러나 삼성전자와 애플의 ``법정공방’’이 파국으로 치달을 가능성은 극히 낮다. 삼성전자와 애플은 서로 공생할 수 밖에 없는 복잡미묘한 관계에 놓여있기 때문.

삼성전자는 애플의 아이폰과 아이패드의 두뇌에 해당하는 ``A4’’ 칩의 유일한 공급업체다. 애플은 또 삼성전자로부터 매년 수조원 규모의 낸드플래시와 액정표시장치(LCD)등의 부품을 구매하고 있다.

애플은 삼성전자로부터 올해 78억달러 (약 8조6천억)상당의 부품을 구매할 것으로 예상되고 있다. 이렇게 되면 애플은 소니를 제치고 삼성전자의 최대 고객사로 부상하게 된다.

이 같은 이유 때문에 삼성은 정작 애플의 본사가 있는 미국은 제외했다. 또 손해배상 규모에 대해서도 언급하지 않았다.

삼성전자의 한 관계자는 ``법적 절차가 비교적 까다롭지 않은 3개국에서 우선 진행하는 것일 뿐, 미국을 제외한 것이 아니다’’고 해명했다.

그러나 익명을 요구한 삼성전자의 다른 고위관계자는 ``법정 싸움이 길어져서 서로에게 좋을 것이 없다’’며 ``좋던 싫던 양사는 서로를 필요로 하기 때문에 적정한 선에서 마무리 될 것’’이라고 말했다.

그는 또 ``삼성의 맞고소는 `간보기’ 차원이 강하다’’며 ``안드로이드진영이 급속도로 커지고 있는데에 따른 일종의 기싸움’’이라고 덧붙였다.

아이패드와 아이폰의 폭팔적 수요증가와 일본 대지진 여파에 따른 부품 차질로 핵심부품에 대한 물량 부족 우려가 현실화되고 있는 상황에서 애플이 삼성과 ``끝장 싸움’’을 벌이기에는 부담이 크다는 풀이다.

애플의 최고운영책임자(COO)인 팀 쿡(Tim Cook)도 최근 1분기 실적컨퍼런스콜에서 ``삼성과의 파트너쉽 관계가 계속 유지되기를 바란다’’며 소송과 비지니스와는 별개의 문제라고 선을 그은 바 있다.

이에 대해 애플코리아의 박정훈 홍보팀 부장은 ``아는 바 없다’’며 즉답을 회피했다.
