Samsung to countersue Apple over patents

In reaction to Apple’s patent suit filed in a U.S. court, Samsung Electronics said Tuesday that it plans to countersue.

“Samsung will sue Apple back,” said spokesman Kevin Jeong, Tuesday.

The iPhone maker argued in papers submitted to the U.S. Court for the Northern District in California that Samsung copied its tablet iPad computer and its smartphone. The suit came a week before the unveiling of Samsung’s Galaxy S II smartphone.

Samsung’s legal team is already in action, gearing up for a review of possible infringement of Samsung’s intellectual property by Apple.

Although Jeong declined to comment, some Samsung officials said that the Korean electronics giant is in for the long haul.

The court website showed Apple is complaining about what it claims is Samsung’s sweeping copying of iPhone products.

“Rather than innovate and develop its own technology and a unique Samsung style for its smartphone products and computer tablets, Samsung chose to copy Apple’s technology, user interface and innovative style in these infringing products,” Apple said.

Patent lawsuits are nothing out of ordinary among technology firms with Apple currently entangled in disputes with Finland’s Nokia, Taiwan’s HTC and Motorola, among others.

Apple’s action comes at a time when Samsung is pushing its Galaxy-branded handheld devices. The company is relying heavily on Google’s Android platform.

The lawsuit came after Apple CEO Steve Jobs accused Samsung of copycatting, and belittled Samsung’s 7-inch Galaxy tablet to be “dead on arrival.” Jobs is still on leave of absence amid rumors that he is seriously ill. He had a liver transplant last time he took time off from the company.

The suit came as a surprise — Apple is a key client for Samsung’s chips and flat-screens.

As of last year, Apple bought 6.2 trillion won worth of Samsung components, which accounted for some 13 percent of Samsung’s annual revenue in its semiconductor business.

Meanwhile, Apple has sued Taiwan’s HTC on 20 counts of patent infringement, dealing with various elements of the iPhone.

HTC later said that it disagreed with Apple and intends to “fully defend itself.”

Apple also filed a suit against Motorola, saying that its touch smartphones use Apple-patented intellectual property.

애플, 삼성 의존도 낮추나?

세계 IT 업계의 거물인 애플과 삼성전자가 특허소송으로 맛붙으면서 애플의 저의에 대해 관심이 쏠리고 있다.

애플사는 지난 15일(현지시각) 미국 캘리포니아 지방법원에 삼성전자가 갤럭시 스마트폰과 스마트패드, 갤럭시탭 등에 자사의 특허와 상표권을 침해했다며 소송을 제기했다.

애플이 상당한 양의 반도체와 액정표시장치(LCD)등을 삼성전자로부터 구매하는 것을 고려할 때 매우 이례적인 일.

이에 삼성전자 역시 법적 대응이 불가피하다며 맞고소에 나서기로 했다. 애플이 최대 고객사중의 한 회사임을 감안, 자사를 폄하하는 발언에도 일절 대응하지 않던 삼성전자가 이번에는 즉각 대응한 것.

삼성전자 홍보팀 정재웅 부장은 ``애플이 삼성전자의 중요한 고객사이기는 하지만, 이번껀은 사안이 다른 일’’이라며 ``맞고소 할 것’’이라고 말했다.

삼성의 속내는 매우 복잡하다. 애플과의 법정싸움이 길어지게 되면 애플에 반도체와 LCD등의 공급에 차질이 생길 수도 있기 때문.

익명을 요구한 한 삼성전자 관계자는 ``싸움이 길어져서 양사에 좋을 것은 없다’’며 ``적정한 선에서 마무리 될 것으로 본다’’고 예상했다.

삼성은 맞소송 방침에 따라 구체적인 일정을 조율하고 있는 것으로 전해졌다.

다른 삼성 관계자는 ``통신표준 영역은 우리 특허가 더 많아 애플이 우리 특허를 침해한 사례가 많을 것으로 판단하고 있다’’고 말해 통신 관련 특허로 맞대응할 것임을 내비쳤다.

업계에서는 애플사의 소송과 관련해 삼성전자를 견제하려는 의도가 있다고 분석하고 있으나 소송 시점이 다소 미묘하다.

애플이 삼성전자에 대한 의존도를 낮추려는 움직임을 보이는 과정에서 이번 사건이 발생했기 때문.

외신들은 애플이 최근 아이패드2의 핵심 부품인 모바일 어플리케이션 프로세서 A5의 생산을 대만 반도체 업체 TSMC와 공급을 논의하기 시작했다고 보도하고 있다. 이 부품은 그간 삼성이 전량 만들어 애플에 공급해 온 것이다.

노근창 HMC투자증권 애널리스트는 ``스마트 디바이스에서 삼성전자와 경쟁하고 있는 애플과 노키아가 삼성전자 반도체 비중을 축소시키는 전략’’이라며 ``더불어 구글의 영향력을 제어하려는 의도도 깔려있는 것 같다’’고 말했다.

애플사는 작년 삼성전자에서 두 번째로 많은 부품을 구매한 업체다. 올해는 약 8조6천억원 가량의 부품을 사들여 삼성전자 최대 고객사로 떠오를 전망이다.
