Man gets 20-year jail term for raping step-granddaughter

A man who raped his step-granddaughter over six years has been sentenced to 20 years in prison. The girl had two children as a result, according to court documents.

Suwon District Court said Thursday that the man, identified only as "A," 53, had raped the girl, "B," 17, since she was an elementary school student.

The attacks started when the girl moved into his house in 2011.

B is a granddaughter of the woman "A" lived with without official marriage registration. The woman took custody of the victim after her parents divorced.

The man was able to keep his attacks secret because he raped the girl when her grandmother was absent, according to court documents. He also told the girl: "I will kill you if you speak out about this."

The grandmother learned of the shocking story early this year and reported it to police.

"It's horrendous and shocking," the court said. "Even though he has no criminal history, a heavy punishment is inevitable."

The man claimed sex with the victim was "always consensual" and he did not know about the babies.




10대 의붓 손녀 유린해 아이 둘 낳게 한 인면수심 50대

어린 의붓 손녀를 장기간 성적으로 유린해온 50대 남성이 징역 20년의 중형에 처해졌다.

    피해자가 초등학생일 때 시작된 성폭행은 고교 진학 후까지 무려 6년간 지속됐으며, 이 때문에 아이를 두 명이나 출산한 것으로 드러나 충격을 주고 있다.

수원지법 형사15부(부장판사 김정민)는 성폭력 범죄의 처벌 등에 관한 특례법 위반(친족에 의한 강간) 등 혐의로 기소된 A(53)씨에 대해 징역 20년을 선고하고, 성폭력 프로그램 160시간 이수를 명령했다고 19일 밝혔다.

    A씨는 2002년부터 사실혼 관계를 유지해온 여성(60대)의 손녀 B(17)양을 상대로 인면수심의 범죄를 저질렀다.

    A씨는 2011년 가을 부모의 이혼으로 함께 살게 된 B양을 '할머니에게 말하면 죽이겠다'라고 협박해 몸을 만지는 등 추행한 데 이어 이듬해 초부터 올해 초까지 경기도 자택과 자동차 안에서 수차례에 걸쳐 B양을 성폭행한 것으로 드러났다.

    이 때문에 B양은 15세 중학생이던 2015년 임신을 하게 됐고, 그해 9월 집에서 아들을 낳았다.

    당시 B양은 아무도 없는 집안에서 혼자 가위로 탯줄을 자른 것으로 조사됐다.

    A씨는 출산 한달도 안 된 같은 해 10월 B양을 재차 성폭행했다.

    잇단 성폭행으로 둘째 아이까지 임신하게 된 B양은 첫째를 낳은 지 10개월 만인 2016년 7월 둘째 아들을 낳았다.

    2016년 말에는 B양의 휴대전화를 검사해 '남자친구가 있는 것 아니냐'고 추궁하며 허리띠로 온몸을 때리는가 하면 두 아기가 잠을 자고 있을 때 옆에서 성폭행하기도 했다.

    무려 6년간 이어진 성적 학대 속에 고교에 진학한 B양은 올해 초 집을 뛰쳐나와 할머니에게 그동안 있었던 일을 알렸고, 할머니의 신고로 경찰 수사가 시작됐다.

    당시 B양은 할머니에게 '더는 이렇게 살고 싶지가 않다'라고 말한 것으로 전해졌다.

    경찰로부터 사건을 이첩받은 검찰은 사안이 중대하다고 판단, 이례적으로 형사부 부장검사가 직접 A씨를 기소했다.

    수사과정에서 A씨는 '합의 하에 성관계를 했고, 일부 범행은 전혀 사실이 아니며 임신한 사실을 알지 못했다'라고 주장했다.

    재판부는 판결문에서 '이 사건 범죄사실은 누가 보더라도 이런 일이 정말 일어난 것이 맞는지 두 번, 세 번 반문하지 않을 수 없을 것'이라며 '여러 사정에 비추어 볼 때 여타 성폭력 사건과는 비교할 수 없을 정도로 죄질이 불량하고 국민적 공분을 사지 않을 수 없다'라고 판시했다.

    이어 '피고인에게 동종 범죄전력이 없는 점 등을 고려하더라도 건전한 성적 도덕관념을 가진 일반인이라면 누구나 납득할만한 중한 형의 선고가 불가피하다'라고 덧붙였다.

    다만 법원은 A씨에 대한 신상정보 공개청구에 대해선 '피해자가 피고인과 친족관계에 있어 공개명령으로 2차 피해가 생길 우려가 있다'라며 받아들이지 않았다. (연합)
