Singer Jo Young-nam received a 10-month jail sentence with two years of probation at his trial on charges of art fraud involving hundreds of paintings, Wednesday.


The Seoul Central District Court gave the verdict on the grounds that his hired "assistants" did more than merely assist, but participated as individual artists.

Jo was indicted in June for earning150 million won ($132,626) by selling the problematic paintings credited to his name between September 2011 and January 2015. He hired other artists to produce the paintings, to which he merely added slight touches before selling them.

Jo earlier denied the accusations, saying he "never thought hiring assistants was a problem or illegal."

1심 '구매자 속였다' 징역 10개월에 집행유예 2년 선고


'그림 대작(代作)' 사건으로 재판에 넘겨져 1심에서 사기 유죄가 인정돼 징역형의 집행유예를 선고받은 가수 조영남(72)씨가 판결에 불복해 항소했다.

19일 법조계에 따르면 조씨는 이날 변호인을 통해 서울중앙지법에 항소장을 제출했다. 항소심 재판은 중앙지법 형사항소부에서 맡게 될 전망이다.

전날 1심을 맡은 서울중앙지법 형사18단독 이강호 판사는 조씨의 사기 혐의를 유죄로 인정하고 징역 10개월에 집행유예 2년을 선고했다.

범행에 가담한 혐의로 함께 재판을 받은 조씨 매니저 장모씨에게도 징역 4개월에 집행유예 1년을 선고했다.

재판부는 조씨의 행위가 그림 구매자들을 속인 것으로 판단했다.

이 판사는 '회화에서는 아이디어나 소재를 제공한 작가가 창작까지 전적으로 관여했는지가 구매 판단이나 가격 결정에 영향을 미칠 수 있다'며 '송씨 등이 그림 표현작업을 주로 한 사실을 고지하지 않고 판매한 건 피해자들을 속인 것'이라고 밝혔다.

이 같은 행위가 국내 미술계의 신뢰성을 훼손하고 미술 시장에 혼란을 초래했다고 이 판사는 부연했다.

조씨는 2011년 9월부터 2015년 1월 중순까지 대작 화가 송씨 등에게 그림을 그리게 한 뒤 가벼운 덧칠 작업만 거쳐 17명에게 총 21점을 팔아 1억5천300여만원을 챙긴 혐의(사기)로 지난해 6월 불구속 기소됐다.

매니저 장씨도 대작 범행에 가담해 3명에게 대작 그림 5점을 팔아 2천680여만원을 챙긴 혐의로 기소됐다.(연합)
