The Seoul High Court sentenced CJ Group Chairman Lee Jay-hyun to two years and six months in prison and a fine of 25.2 billion won ($21.3 million) after reviewing his convictions for embezzlement, tax evasion and breach of trust.

The decision was made at a review three months after the Supreme Court sent the case back to the high court in September, citing an improper application of the law on breach of trust.

The ruling was unusual because many corporate heads convicted of financial crimes receive suspended prison terms and are later pardoned by the president.

"It was inevitable to hand down the jail term to Lee although we took many things into consideration," the judge said. "We want to make it clear that such corporate crime should be strictly punished if a person breaks the law for personal interest through evading taxes and embezzling, even if he is head of a conglomerate, to prevent similar cases."

The judge said that he considered Lee's health and the positive influence his return to his position would have on the economy.

"However, we had to put more emphasis on his social responsibility, because large conglomerates take up a huge portion of the country's economy and thus they need to take that much responsibility," he said.

Lee, who attended the hearing in a wheelchair, did not move for about 10 minutes even after the ruling was finished. His aides then helped him exit the courtroom.

Lee was indicted on charges of misusing 165.7 billion won through embezzlement, tax evasion and breach of trust in July 2013.

In an appeal he was found guilty of embezzling 11.5 billion won and evading 25.1 billion won in taxes and breach of trust. However, as the losses from the breach of trust could not be accurately calculated, the court said that it reduced his jail term from the original sentence of three years.

Lee was not put behind bars immediately, as his medical parole will be valid until March 21 next year. He requested the parole for medical treatment when he filed an appeal in November.

Lee has suffered multiple health problems such as Charcot-Marie-Tooth (CMT) disease and side effects following a kidney transplant in 2013. CMT is a genetic disease that causes peripheral nervous system disorders, weakening muscle tissue and sense of touch.

CJ Group said it would not accept the court decision and would again appeal to the Supreme Court.

Previously, the Seoul Central District Court sentenced him to four years in prison and a fine of 26 billion won for embezzling 71.9 billion won, tax evasion totaling 26 billion won and causing 36.3 billion in losses to the firm.

But the high court reduced his jail term to three years, recognizing a lower amount of embezzlement, tax evasion and losses to the company.

While upholding the high court ruling on embezzlement and tax evasion, the Supreme Court ordered the review, saying the high court misapplied a related law on breach of trust.


'재벌 집행유예 공식' 깨졌다…이재현 회장도 실형

이재현 CJ 회장이 15일 파기환송심에 받은 실형 선고는 이 회장 측이 대법원에 재상고를 해도 바뀔 가능성이 작다. 대법원은 대부분 혐의를 유죄로 봤고 파기환송심은 대법원의 판단을 따랐기 때문이다.

이에 따라 이 회장이 받은 징역 2년6개월은 대법원에서 그대로 확정될 확률이 높다. 형이 확정되면 2010년대 들어 SK그룹 최태원 회장에 이어 재벌 총수에 대한 두 번째 실형 선고로 기록될 전망이다.

법조계에 따르면 주요 기업 총수 중 배임·횡령·탈세 등 기업범죄를 저지르고 실형이 선고된 사례는 상당히 드물다. 1심에서 실형을 받아도 상급심에서 집행유예로 풀려난 사례가 더 많다. 

이건희 전 삼성그룹 회장은 2008년 배임·탈세 혐의로 불구속 기소돼 징역 3년에 집행유예 5년을 선고받았다. 구형량인 징역 7년을 크게 밑도는 양형이다.

정몽구 현대차그룹 회장도 비자금·횡령 등으로 징역 3년 집행유예 5년을 받았다. 2001년 항공기 도입 과정에서 비자금을 조성하고 세금을 포탈한 혐의로 기소된 조양호 대한항공 회장의 형량도 징역 3년에 집행유예 5년이었다.

비자금 조성·횡령 혐의 등으로 기소된 두산그룹 박용오·박용성 전 회장 형제는 나란히 징역 3년에 집행유예 5년을 받았다. 김승연 한화그룹 회장은 계열사 주식을 가족에 헐값에 넘기는 등 회사에 수천억원의 손해를 끼친 혐의로 실형을 받았다가 파기환송심에서 징역 3년에 집행유예 5년이 선고됐다.

집행유예로 풀려나는 '재벌 양형공식'은 그러나 2009년 대법원 양형기준이 시행된 이후 조금씩 바뀌고 있다. 형을 정하는 구체적 지침이 생기며 과거처럼 '경제발전 기여' 등을 사유로 석방하기가 어려워졌다.

이 회장의 파기환송심 재판부는 이날 '재벌 총수라 해도 법질서를 경시하고 개인의 이익을 위해 조세 포탈, 재산범죄를 저지르면 엄중히 처벌한다는 점을 명확히 해 건전한 시장경제 질서 확립과 공평한 사법체계를 추구해야 한다'고 했다.

실제로 SK그룹 최태원 회장의 경우 SK그룹 계열사의 펀드 출자금 수백억 원을 빼돌려 옵션투자 위탁금 명목으로 전 SK해운 고문에게 송금한 혐의로 대법원에서 징역 4년의 실형을 확정받았다. 그는 2년6개월 복역하다 올해 사면됐다.

함께 기소됐던 동생 최재원 수석부회장도 대법원에서 징역 3년6개월을 선고받고 현재까지 수감 중이다. 태광그룹 이호진 회장의 모친인 이선애 상무도 징역 4년을 받고 확정됐다. 이 상무는 형집행정지로 투병 중 별세했다.

회삿돈을 빼돌려 미국 라스베이거스에서 상습 도박을 한 장세주 동국제강 회장도 최근 법원에서 징역 3년6개월을 받았다. (연합뉴스)
