Lawmaker’s sex scandal comes back to haunt him

During a prostitution crackdown in the summer of 2009, Gangnam Police Station received a phone call. “A member of the National Assembly is at a hotel in Gangnam with a women, whom he paid to spend the night with,” said a caller. Police officers immediately went to the hotel the caller named.

Upon running into them, the Assemblyman showed his identifications. Instead of taking him to the police station, they took him to a third location. It can be guessed that this decision was made to treat the politician with respect.

When questioned with the identity of the woman he was with, the lawmaker was quick to claim her as "just a girlfriend." After a couple of days, he was again investigated in another place. He continuously replied that the woman was his girlfriend with whom he went on a trip to Southeast Asia. Showing air tickets, he tried to claim that this incident had nothing to do with sex trafficking.

Because there was no hard evidence to seek a warrant, the police decided to book him, not writing down the assemblyman’s real name on the report. Since this happened due to an anonymous tip, they could not erase all the details and they thought it was unreasonable to officially name those involved for the lack of evidence. However, the real name was reported verbally.

This happening was brought to light recently after it was revealed that the politician was a member of a special parliamentary committee to overhaul the judicial system.

A lawyer, who was a former judge, claimed, “It’s suspicious to just book a politician after two rounds of investigations. If the charge wasn’t clear enough, would police officers have gone to the hotel in the first place?” The police were quick to reply that they couldn’t remember anything, while prosecutors said that they only respected the decision made by the police.

“I think there was a misunderstanding because the hotel also had a bar in the same building. After the two investigations, I was able to clear up the confusion. I understand that during the crackdown, some famous people were caught. I have been acquitted from all charges,” the lawmaker said in a recent interview with the Dong-A Ilbo newspaper.



2009년 성매매 제보받은 경찰, 강남의 한 호텔 출동해 보니

2009년 여름 성매매 일제단속 중이던 서울 강남경찰서에 신고전화 한 통이 걸려왔다. “A 국회의원이 강남의 한 호텔에서 유흥업소 여성에게 돈을 주고 관계를 하고 있다”는 내용이었다. 경찰은 즉시 지목된 호텔로 출동했다.

경찰과 맞닥뜨린 A 의원은 경찰에 국회의원 신분증을 제시했다. 경찰은 A 의원을 경찰서가 아닌, 제3의 장소로 ‘모셨다’. 국회의원에 대한 예우 차원에서 이뤄진 조치로 풀이된다.

경찰은 A 의원을 상대로 함께 있던 여성의 신분을 추궁했으나, A 의원은 ‘친구’라고 강하게 반박했다. 경찰은 며칠 뒤 다시 A 의원을 제3의 장소로 불러 한 차례 더 조사했다. 이 자리에서도 A 의원은 줄기차게 ‘친구’라고 주장했다. 동남아시아로 여행도 함께 다녀온 사이라며 항공권을 증거 자료로 제출하기도 했다. 성매매 위법사건이 성립할 수 없다는 논리를 댄 것이다.

당시 경찰 수사 관계자는 동아일보 기자와 만나 “A 의원은 애인과의 일을 왜 성매매 혐의로 조사하느냐는 어투였다. 굉장히 억울해하고 불쾌해했다”며 “항공권을 비롯해 여러 가지 자료를 제출해 화제가 됐다”고 전했다.

경찰은 A 의원을 ‘불입건’하기로 하고, 수사 지휘처인 검찰에는 ‘어느 국회의원’이라고만 적어 기록을 제출했다. 신고전화가 접수돼 현장에 출동한 사건이어서 기록 자체를 없앨 수는 없었지만 성매매에 관해서는 혐의가 드러나지 않은 만큼 실명을 밝힐 수는 없다고 판단했다는 것. A 의원의 실명 등 신상에 대해서는 구두 보고했다.

2년 전 발생한 이 사건은 최근 관가에서 불거져 나왔다. A 의원은 국회 사법제도개혁특별위원회 소속. 사개특위는 경찰의 수사개시권을 명문화하는 검경 수사권 조정을 추진하고 있어 미묘한 파장을 불러일으키고 있다.

한 판사 출신 변호사는 “현직 의원을 두 번씩이나 조사해놓고도 불입건한 것이 석연치 않다”며 “혐의가 분명하지 않다면 아무리 현장을 급습했더라도 국회의원 연행 조사가 가능했겠느냐”고 반문했다. 이에 대해 경찰 수사 관계자는 “자세한 내용은 잘 기억나지 않는다”고 했다. 경찰 수사를 지휘했던 검사는 “‘성매매 혐의가 입증되지 않는다’는 경찰의 판단을 존중한 것으로 기억한다”고 말했다.

A 의원은 본보와의 통화에서 “해당 호텔이 술집과 객실이 함께 있는 형태여서 오해가 벌어진 것 같다”며 “당시 일제단속에서 저명인사들도 걸렸는데, 나는 두 차례의 경찰 조사에서 모든 오해를 풀었고 무혐의 처분으로 종결된 사안”이라고 말했다.
