A National Intelligence Agency (NIS) covert operations officer, known as "Mr. Kim," was arrested Wednesday by prosecutors on suspicion of being involved in fabricating a document used as evidence during an espionage trial.

Mr. Kim is the first NIS officer to be arrested as part of a prosecution task force's investigation into fabrication of evidence used against Yu Woo-sung, a former Seoul city government official accused of spying for North Korea.

Following the arrest of the covert officer, prosecutors planned to summon and question the chief of the anti-communism investigation team.

Mr. Kim reports to this team leader, so the task force is expected to inquire if the boss was aware of the forgery and if he ordered it to be done.

This move indicates that the prosecutors' investigation will be moving closer to the upper level of the hierarchy at the NIS to decide if the spy agency was involved in the fabrication of evidence.

The arrest warrant for Mr. Kim was issued around 12:45 a.m. Wednesday. Kim Seung-joo, a judge at Seoul Central District Court, said in a statement, "The charges are serious, and the court accepts the reason for an arrest and the necessity for it."

During the interrogation by prosecutors and at the court hearing for issuing an arrest warrant, Mr. Kim reportedly denied charges that he knew the document given by his long-time civilian collaborator was fabricated.

The 61-year-old civilian informer, identified as Kim, was arrested on Saturday and told the prosecution that the document was forged and that the NIS was aware of it.

In the meantime, the prosecution and the Ministry of Justice dispatched a team to China on Wednesday to seek cooperation on the investigation from the country's Ministry of Public Security.

The team is also considering visiting the Korean consulate in Shenyang, northeastern China, and the Sanhe checkpoint or border authority. Both Yu's attorneys and the prosecution claim that they obtained statements on Yu's travel records from the Sanhe checkpoint. The statement, which the NIS provided to prosecutors, was declared to be fabricated by the Chinese embassy in Korea.


檢 '증거조작 의혹' 국정원 비밀요원 구속

법원 '범죄혐의 중대하고 구속 필요'…'윗선' 수사 속도

간첩사건 증거조작 의혹의 핵심 인물로 꼽히는 국가정보원 김모 과장이 19일 검찰에 구속됐다.

검찰이 문서위조 의혹 수사에 나선 이후 현직 국정원 직원을 구속하기는 김 과장이 처음이다. 일명 '김 사장'으로 불리는 김 과장은 신분을 숨기고 일하는 국정원 비밀요원이다.

김 과장의 구속전 피의자 심문(영장실질심사)을 맡은 서울중앙지법 김승주 영장전담 판사는 '범죄혐의가 중대하고 구속사유와 그 필요성이 인정된다'고 영장 발부 이유를 밝혔다. 서울중앙지검 진상조사팀(팀장 윤갑근 검사장)은 곧바로 영장을 집행했다.

검찰에 따르면 김 과장은 지난해 12월 국정원 협조자 김모(61·구속)씨를 만나 간첩사건 피고인 유우성(34)씨의 변호인이 제출한 중국 싼허(三合)변방검사참(출입국사무소)의 정황설명서를 반박하는 내용의 문건 입수를 요구한 것으로 알려졌다.

김씨는 중국에서 관인 등을 위조하고 싼허변방검사참 명의 답변서를 만들어 김 과장에게 전달했다. 답변서는 국정원 직원인 중국 선양(瀋陽) 주재 총영사관 이인철 교민담당 영사를 거쳐 검찰로 넘어갔다.

이 답변서는 검찰의 문서감정 결과 중국대사관이 진본이라고 밝힌 변호인측 문건과 관인이 달라 사실상 위조로 판명됐다.

검찰은 지난 15일 조사를 받으러 온 김 과장을 체포하고 17일 구속영장을 청구했다. 검찰은 김 과장에게 위조사문서행사와 모해위조증거사용 등의 혐의를 적용했다.

협조자 김씨는 검찰에서 '문서가 위조됐고 국정원도 알고 있었다'는 취지로 진술했다. 그러나 김 과장은 위조 사실을 몰랐다고 주장하는 것으로 전해졌다.

그는 전날 오후 3시부터 2시간여에 걸쳐 진행된 영장실질심사에서도 '검찰이 김씨의 진술만으로 구속하려 한다'며 혐의를 부인한 것으로 알려졌다.

검찰은 김 과장이 국정원 본부의 지시를 받아 위조 의혹이 제기된 문서 3건에 모두 직·간접 관여했을 가능성에 무게를 두고 있다. 검찰이 김 과장을 구속함에 따라 국정원 '윗선'의 조직적 개입 여부에 대한 수사에 속도를 낼 수 있을지 주목된다.
