Q) I am a Russian national and married to a Korean, and we have children together. I have an F5 residing visa. If we separate or divorce, does my F5 visa expire? And what would happen to my children?

A) In the case of divorce, you don’t need to surrender your F-5 visa.

Q) In the F-5 visa regulations, I read that it is okay to change jobs but you must not leave the country to get a new visa.

My husband currently got a new visa because he changed jobs, however, he has been asked to leave the country. He used to work at a “hagwon (private educational institute),” but now he works at a kindergarten. He was told that he must leave the country as his employer had changed.


A) According to the Seoul immigration office, to apply for an F-5 visa, you must hold the same visa ― in your case an E-2 visa for more than five years ― without leaving the country. However, it is acceptable to leave the country for less than three months with a re-entry permit.

There are certain instances where you are not required to leave the country when you change the place of your employment. These are: If you have worked for the same employer for five years or more or when your employer is undergoing financial difficulties.

Q) I am an F-5 visa holder and I understand that I can leave Korea for up to one year at a time and keep this visa.

I recently learned that I must leave Korea soon for an indefinite period. Is there any way I can keep my visa valid for longer than one year?


A) According to the immigration office, you can leave the country for more than one year if you get multiple re-entry permission before you leave. The multiple re-entry permit allows you to leave the country for up
to 2 years.
