Bluffing not cause for annulment

Bluffing doesn’t constitute a cause for annulment of marriage, the court ruled Monday.

A woman found out that her husband lied about his scholastic, financial, and family background and some details about his former marriage. Feeling defrauded, she asked for an annulment, but the court said that the case is not for an annulment but for a divorce.

“A court grants an annulment only when it recognizes an intention to defraud by illegal means such as falsely informing the other party,” said the judge in its ruling.

“Mutual affection and trust should be the foundation of a marriage, but some choose to play up or down personal information even when they have to add or leave out some details. Not to disclose some information at all is also a personal choice,” he added.

The court granted their divorce saying that the couple has no intention of working out the marriage. It also ordered the husband to pay 15 million won ($13,000) in compensation for emotional distress on the wife’s part.
