Kang’s lawyer argued that punishment for such incidents can only apply to acts on children but not on the spouse.
He went on to say that the crime can only be admissible by law when the couple has agreed to a separation or divorce.
The defending attorney said issues such as this occur under intimate circumstances and there are no witnesses who can testify to what actually occurred.
Nevertheless, Kang was sentenced to three and a half in jail and six years in prison in two subsequent sentencing and the case is awaiting a final decision of the Supreme Court.
