Court rules dismissal of school teacher for adultery unfair

A district court in Gwangju ruled Sunday it was unfair that a school teacher was dismissed for committing adultery with a fellow female teacher.

The court ruled in favor of the plaintiff, 39, who filed a lawsuit against the authorities, demanding that the superintendent of schools in Gwangju to withdraw his dismissal.

In its ruling, the court said, “It was recognized that the teacher committed adultery with her. But depriving him of his post for it was too heavy amid controversy over constitutionality of punishment for adultery.

“In particular, his dismissal was unfair, given that disciplinary measures were already taken against the female teacher in the form of a three month salary cut. The superintendant in this instance has abused his power.”

The teacher at an elementary school in Gwangju was indicted on charges of committing adultery with her five times between June and September 2010.

Last February, the Gwangju Office of Education sacked him, claiming that he sexually assaulted her and blackmailed her to remain quiet over the affair.
