Sex in Jail

In the backdrop of rise in the number of HIV positive prisoners, the Bombay High Court has asked Maharashtra government to examine the possibility of allowing jail inmates to have sex with their wives in privacy, according to The Times of India.

The state government was asked to explore the possibility of facilitating prisoners, who have been lodged for two to three years in jail, to meet their wives sometime every month.

The judges asked the government to look into the issue because they were of the view that HIV positive cases could be possibly because of unprotected or unnatural sex.

Advocate Anand Grover, appointed amicus curiae (friend of the court) in the case, said, "Whether we like it or not, there is sex in jails. It is an issue which everyone wants to sweep under the carpet."

To a query by the court, he said allowing conjugal rights to prisoners were an accepted norm in some Asian and European countries.

Justice Majumdar observed, "There may be physical needs. See whether a separate place can be given to a prisoner and his wife for a day or two.''

인도 재소자 `섹스면회' 허용 검토

인도의 교도소가 에이즈 확산 통로가 되고 있다는 지적 속에 현지 법원이 재소자들에게 '섹스 면회'를 허용하는 게 필요하다고 주장하고 나섰다.

타임즈 오프 인디아에 따르면 봄베이 고등법원은 에이즈 감염 재소자 처우를 위한 공익소송 심리에서 2-3년 이상 감옥에서 보낸 수감자들이 매달 정기적으로 부부관계를 맺을 수 있도록 하는 방안을 검토하라고 마하라슈트라 주 정부에 주문한 것으로 나타났다.

재판부의 이 같은 명령은 교도소 내부에서 벌어지는 안전하지 못한 성 관계가 에이즈 확산을 부추기고 있다는 지적에 따른 것이다.

원고 측 변호를 맡은 아난드 그로버 변호사는 "우리가 좋아하든 그렇지 않든 교도소 내에도 섹스는 존재하지만 이를 쉬쉬해왔다"며 "재소자의 섹스는 일부 유럽과 아시아 국가에서 허용되고 있다"고 덧붙였다.

이에 대해 P.B. 마줌바르 판사는 "재소자들에게도 섹스가 필요할 수 있다. 재소자와 그 부인에게 하루 또는 이틀 동안 지낼 수 있는 독립된 공간을 제공할 수 있는 지 검토하라"고 말했다.
