Protracted Period of No Sex No Grounds for Divorce

The Supreme Court ruled Wednesday that a prolonged period without sexual activity between a husband and wife does not provide adequate grounds for a divorce.
The decision upheld a decision by the lower courts, and likely sets a clear guideline for similar cases. The courts have not been consistent so far over the issue.
The latest legal battle involving a couple's life in the bedroom began last year when a 36-year-old husband, identified by his surname Kim, filed for divorce from his 27-year-old wife, claiming that she had refused to engage in sexual relations since they tied the knot in 2005.
A provincial and appellate court rejected his claim, saying the husband did not make sufficient efforts to bring the soured relations back on track.
"If a couple cannot have a normal sexual relationship due to one party's refusal without justifiable reason or sexual dysfunction, it could provide a cause for divorce," Justice Yang Seung-tae said in the ruling.
"But if it's still possible for the troubled couple to have an opportunity to normalize their sexual life with the help or treatment of experts, temporary sexual dysfunction or temporary cessation of sexual activity cannot be considered a cause for divorce," he said.
The highest court seemed to be emphasizing the need for both parties to try to normalize troubled marriages at a time when the social institution is being threatened at its root.
A recent survey by the Korea Institute for Sexology showed that nearly 30 percent of couples in their 20s and 40s have not had sexual relations in the past two months.

배우자가 부부관계를 거부해도 관계개선을 위한 노력을 하지 않았다면 이혼을 요구할 수 없다는 대법원 판결이 나왔다.
대법원2부(주심 양승태 대법관)는 김모(36)씨가 결혼식 당일부터 이유 없이 성관계를 거부해 결혼생활을 파탄나게 했다며 아내인 이모(27)씨를 상대로 낸 이혼 청구 소송에서 원고 패소로 판결한 원심을 확정했다고 6일 밝혔다.
재판부는 "정당한 이유 없이 성관계를 거부하거나 성기능 장애로 정상적인 성생활이 불가능하다면 결혼생활을 지속하기 어려운 중대한 사유가 되지만, 전문가의 치료나 도움으로 정상적인 성생활로 돌아갈 가능성이 있는 경우에는 일시적인 성기능 장애나 성적인 접촉의 부존재가 중대한 이혼 사유가 될 수 없다"고 밝혔다.
재판부는 "김씨가 아내와의 관계 개선을 위한 노력이나 시도를 하지 않았고, 혼인관계가 더 이상 회복할 수 없을 정도로 파탄났다고 인정하기 어렵다고 본 원심의 판단은 정당하다"고 설명했다.
대법원의 이번 판결은 결혼이라는 제도가 뿌리째 흔들리고 있는 현 상황에서 양측이 난관에 봉착한 결혼을 정상화하기 위한 노력을 할 필요가 있다는 점을 강조하기 위한 것으로 풀이됐다.
최근 한 설문조사에 따르면 20-40대 부부의 거의 30%가 지난 두 달 동안 부부관계를 갖지 않은 것으로 나타났다.
