Legal Battle Over Portrait

Dear editor,

I'm writing in response to an Oct. 2 Korea Times article, ``Singer Yang Sued for Using Own Portrait.''

Concerning the lawsuit of Sion Khan vs. Yang Dong-geun, I would like to represent Yang in the lawsuit. Bae has no creditability on both claims.

I did a Fermi estimation which proves that Bae would have to now be 60 years old, drawing at least 45 faces everyday of his life beginning at the age of one, to have drawn 1,000,000 faces.

Thus that claim is false. If indeed, Bae filed a copyright notice on that particular sketch (which I doubt), then Yang could counter-sue as the sketch was done without consent. If that doesn't work, then Yang still has other avenues within the law.

Bae should be quite happy that Yang honored his work by portraying it on his album jacket. Further, Bae did state he gave the work to him ``without any cost or conditions.''

For example, a condition could have been ``You may not use this gift as promotional material for material or monetary gain.'' Thus, Yang is free to do with it as he likes.
