A court ruled Sunday that showing a video comprised of sex scenes edited together from a publicly released film was a form of sexual harassment.
Seoul Central District Court fined a 37 year-old office worker, surnamed Cho, three million won, and ordered him to undergo 40 hours of therapy for sex crimes, after finding him guilty of sexually harassing a female colleague with the video. It also ruled that the video could be construed as pornography that was used to harass the woman.
Cho argued that the video was not “illegally produced porn” as it came from a legitimate Korean film that opened in theaters and was approved by Korea Media Rating Board. However, the court disagreed, saying that if the video, no matter how it was made, caused the victim to feel sexually harassed, then criminality applied.
The judge was quoted by a local online vernacular as saying, “The victim expressed to the accused that she was severely distressed after seeing the video...and testified the same to prosecutors.”
