애플-삼성, 합의 수순?…ITC판정 항고 나란히 취하

Apple purchasing more Samsung components

A long-running patent fight between Samsung Electronics and Apple is showing signs of a ceasefire, sources familiar with the negotiations said Monday.

"We are trimming down the number of disputed issues. We no longer want to spend time talking about secondary points," said an industry official, asking not to be named. "Both firms are trying to find common ground."

"It's too early to say that the ongoing working-level talks will produce an immediate breakthrough, but we are more practical about trying to find a solution," said the official.

Apple and Samsung recently agreed to cut one of their many patent disputes, according to Florian Mueller of FossPatents and other sources.

He said the two firms filed motions to completely drop all cross-appeals related to last year's U.S. International Trade Commission (USITC) ruling that determined Samsung infringed on two Apple patents covering a touchscreen interface feature and a headset plug detection technology.

"The previous USITC decision that nullified the so-called 678 patent — which was infringed on — and a separate verdict that ruled Apple infringed on some Samsung patents, encouraged Samsung to get smarter in its fight with Apple," said the official.

While the import ban against some Samsung devices technically remains in effect, it no longer makes those products, and has already applied "modified technologies" on new phones and tablets that avoid Apple patents.

Meanwhile, Samsung is continuing its partnership with Apple by selling more components, such as displays and semiconductors.

Data showed that Apple was one of the top three clients for Samsung displays in the first quarter of the year.

Apple's portion out of the total Samsung's display sales rose to over 9 percent during the period.

DisplaySearch, a market research firm, said Samsung Display, a display panel unit of Samsung, shipped 5.2 million displays mostly to be used in Apple's 9.7-inch iPad in the first three months.

Bernstein Research also said Samsung is seeing progress in baseband technologies by improving its systems chips with modem and application processors, another sign of normalizing its Apple business.

"As technology shifts toward wearable devices, Apple still wants to keep Samsung as its top-tier parts sourcing channel," another source said.

"The recent release of the Samsung OLED tablet is an indication that Samsung can manage OLED displays to be used in almost all wearable devices, a segment that Apple is greatly interested in."


애플-삼성, 합의 수순?…ITC판정 항고 나란히 취하

스마트폰·태블릿PC 특허를 놓고 전쟁을 계속하던 애플과 삼성전자가 최근 미국에서 나란히 항고를 취하한 것으로 알려져 주목된다.

독일의 지적재산권 전문 블로그 포스페이턴츠는 지난 12일(이하 현지시간) 삼성전자가 미국 연방 항소법원에 국제무역위원회(ITC) 판정에 대한 항고를 취하했으며, 애플도 이튿날 같은 판정에 대한 항고를 취하했다고 14일 전했다.

삼성전자는 항고를 취하하면서 항소법원에 제출한 문건에서 '피항고인인 ITC와 (다른) 소송참가자인 애플과 협의(confer)했으며, 양쪽 모두 자발적인 소송 취하에 반대하지 않았다'고 밝혔다.

애플은 '삼성전자의 항고 취하는 ITC의 (삼성 제품) 수입금지 명령이 유효하다는 의미'라고 지적하며 역시 항고를 취하했다.

포스페이턴츠를 운영하는 특허전문가 플로리안 뮐러는 '공식적으로는 (삼성 제품의 수입금지 명령이 유효하다는) 애플의 지적이 맞다'면서도 '상업적인 의미로는 애플이 삼성전자와의 ITC 분쟁에서 아무것도 얻지 못한 것'이라고 설명했다.

삼성전자의 수입금지 제품들은 갤럭시S, 갤럭시S2, 갤럭시 넥서스, 갤럭시탭 등 구형 제품들이고 삼성전자는 이미 애플의 특허를 우회한 새로운 제품을 시장에 내놓고 있기 때문이다.

이에 따라 3년여를 끌어온 특허 분쟁을 합의로 끝내려는 포석이 아니냐는 분석이 나오고 있다.

실제로 애플은 지난달 16일 삼성전자의 '우군'인 구글과 공동 성명을 내 '현재 두 회사 사이에 직접적으로 존재하는 모든 소송을 취하하기로 합의했다'고 밝힌 바 있다.

당시 애플은 구글과의 합의가 삼성과의 소송에는 영향을 주지 않는다고 말했지만, 업계에서는 삼성과도 합의에 이르는 수순을 밟고 있는 게 아니냐는 예상이 끊이지 않았다.

뮐러는 '만약 애플과 삼성전자가 어떤 종류의 합의에 이르지 않았다면, 이론적으로 애플은 삼성이 침해한 것으로 인정받은 이른바 '스티브 잡스 특허'(미국특허 7,479,949)와 관련한 추가 배상금을 요구할 수 있다'면서 양사가 어느 정도 합의에 성공했을 거라는 점을 시사했다.

이어 '이를 낮은 단계의 합의라고 부른다면 과장이 될 것이며 애플-삼성 사이에는 지난달에 합의에 이른 애플-구글과 달리 '해빙기'에 이르렀다는 신호가 아직 없다'면서도 '그러나 그들은 어디선가는 (합의를) 시작해야 한다'고 지적했다. (연합뉴스)
