The Supreme Court sent the ruling that found Rep. Park Jie-won guilty on bribery charges back to the Seoul High Court, Thursday. The 74-year-old independent lawmaker, previously sentenced to a one-year prison term suspended for two years, will retain his parliamentary seat.

The top court ordered the high court to review his bribery charges, citing unreliable testimonies of the alleged bribers.

Previously, the Seoul High Court found him guilty of accepting 30 million won in 2010 as a kickback from Oh Moon-cheol, former head of Bohae Savings Bank, overturning a lower court ruling that found him not guilty.

"The lower court ruling, which did not recognize the reliability of Oh's testimony, was more reasonable," a judge of the top court said.

"Oh's testimony lacks credibility as a whole as it conflicts with objective facts from his other testimony on bribery," the judge said.

Park was indicted on charges of taking a total of 80 million won in kickbacks from several ailing savings banks in return for influence-peddling between 2008 and 2011.

Park was suspected of taking 30 million won in bribes from Oh in 2010 in return for helping the bank avoid investigation by prosecutors.

Park was also accused of receiving 20 million won in illegal political funds from former Solomon Savings Bank CEO Lim Suk in 2008.

The political heavyweight was also suspected of taking 30 million won from Lim Kun-woo, former chairman of Bohae Brewery and a major shareholder in the savings bank, in return for having the Financial Supervisory Commission postpone its management evaluations of the troubled lender's solvency in 2011. The lender was absorbed into Yes Savings Bank.

In a separate case, Park was indicted in 2003 on charges of taking slush funds from Hyundai Group before the historic inter-Korean summit in 2000 but was cleared of the charges by the Supreme Court.

He was also sentenced to three years in jail for receiving kickbacks from some conglomerates but pardoned in 2006 while serving his sentence.

Park defected from the main opposition Minjoo Parity of Korea in January and declared that he will remain an independent lawmaker. Park, a three-term legislator, served under former President Kim Dae-jung as chief of staff and culture minister.

'오문철 전 대표 진술 신빙성 없어'…일부 유죄 원심 파기환송
박지원 '13년간 표적수사 받아…총선 출마할 것'

저축은행에서 뒷돈을 받은 혐의로 항소심에서 일부 유죄가 선고된 무소속 박지원(74) 의원이 다시 재판을 받는다. 파기 환송심이 남았지만 대법원 판결로 의원직을 유지할 뿐만 아니라 사실상 혐의를 모두 벗었다.

대법원 3부(주심 김용덕 대법관)는 18일 특정범죄가중처벌법상 알선수재 등 혐의로 기소된 박 의원에게 징역 1년에 집행유예 2년, 추징금 3천만원을 선고한 원심을 깨고 전부 무죄 취지로 사건을 서울고법에 돌려보냈다.

재판부는 2010년 6월 오문철 당시 보해상호저축은행 대표로부터 '검찰 수사가 잘 마무리될 수 있도록 도와달라'는 청탁과 함께 3천만원을 수수한 혐의를 유죄로 본 원심 판결이 잘못됐다고 판단했다.

앞서 2심은 1심의 전부 무죄 판결을 깨고 오 전 대표에게 금품을 수수한 혐의를 유죄로 변경하고 집행유예를 선고했다.

재판부는 '오 전 대표 진술의 신빙성에 대해 1심이 제기한 의심이 합리적'이라며 '또 다른 금품 제공사실에 관한 오 전 대표의 진술이 객관적인 사실과 정면으로 배치되고 있어서 신빙성이 전체적으로 상당히 허물어졌다고 봐야 한다'고 지적했다.

2011년 3월 임건우 전 보해양조 회장과 함께 박 의원을 찾아가 3천만원을 전달했다는 진술이 믿기 어려운 만큼 다른 진술도 신빙성이 없다는 얘기다. 오 전 대표와 임 전 회장의 진술이 엇갈리고 오락가락해 1·2심 모두 이 부분은 무죄로 판결했다.

재판부는 오 전 대표 진술을 의심하는 대신 이와 배치되는 동석자의 말을 믿기 어렵기 때문에 오 전 대표 진술에 신빙성이 있다는 식의 입증 방법이 잘못됐다고 지적했다.

돈을 건넸다는 오 전 대표의 진술 자체도 반대되는 정황이 여럿 있어 신빙성을 확신할 수 없다고 재판부는 판단했다. 오 전 대표보다 더 친분이 있던 임석 전 솔로몬저축은행 회장이 비슷한 시기 건넨 2천만원을 거절한 점, 오 전 대표가 면담에 앞서 입금한 공식 후원금 300만원을 사흘 만에 돌려준 점 등이다.

재판부는 임건우 전 회장에게 금융위원장 청탁 명목으로 3천만원을 수수한 혐의, 2008년 3월 임석 전 회장에게서 선거자금 2천만원을 받은 혐의는 모두 무죄 판단을 유지했다.

앞서 1·2심에서도 오 전 대표 등 금품공여자들 진술의 신빙성 판단에 유무죄가 갈렸다.

1심은 공여자들 진술을 전부 믿을 수 없다고 보고 무죄를 선고했다. 그러나 2심은 돈을 건넸다는 오 전 대표 진술이 일관되고 합리적이라며 유죄 판결했다.

2심은 두 사람 면담을 주선하고 동석했다는 경찰관 한모씨의 진술이 오히려 믿기 어렵다고 지적했다. 오 전 대표는 박 의원과 단둘이 만났다고 말했다. 반면 박 의원과 한씨는 세 사람이 동석했고 돈이 오가지는 않았다고 주장했다.

2심은 '한씨 진술이 일관되지 않고 석연치 않은 점이 많다. 이와 일치하지 않는 오 전 대표 진술에 신빙성을 더해주는 요소가 될 수 있다'며 박 의원의 금품수수를 인정했다.

박 의원은 선고 직후 '13년간 표적수사로 고초를 겪었지만 사법부의 정의로운 판단에 의거해 당당하게 정치활동을 할 수 있게 돼 기쁘다. 이런 불행한 일이 다시는 우리 정치권에 일어나서는 안 된다는 각오로 총선에 출마하겠다'고 말했다. (연합뉴스)
