According to a New York Times report, Jorge Canal who lives in Iowa is on the sex offenders registry because, at age 18, he was convicted of distributing obscene materials to a minor after he sent a picture of his penis by cellphone to a 14-year-old female friend who had requested it.

In most states, teenagers who send or receive sexually explicit photographs by cellphone or computer ― known as "sexting" ― have risked felony child pornography charges and being listed on a sex offender registry for decades to come.

Thus there is growing consensus among lawyers and legislators that the child pornography laws are too blunt an instrument to deal with an adolescent cyberculture in which all kinds of sexual pictures circulate on sites like MySpace and Facebook.

A bill moving through the state House would make sexting a less serious offense for teenagers than for adults. Under the current law, minors who send sexually explicit photographs from one cellphone to another could be convicted of a felony.



미 청소년 `섹스팅' 처벌 논란

뉴욕타임즈에 따르면 미국 아이오와 주에 사는 18살의 조지 카날은 14살 소녀의 요청에 따라 자신의 성기 사진을 휴대전화로 보내 미성년자에게 음란물을 유포한 혐의로 성범죄자 명단에 올라 있다.

미국 대부분의 주에서 10대들은 휴대전화나 컴퓨터로 선정적인 사진들을 받거나 보내는 행위인 `섹스팅'으로 인해 중범죄인 아동 음란물 관련 혐의와 성범죄자 명단에 수십 년 간 오르게 되는 위험에 직면해 있다.

이에 따라 법조계는 현재 많은 사이트에서 성적인 사진들이 돌아 다니고 있는 가운데 아동 음란물 관련 법으로 청소년 사이버문화를 다루는 것이 부적절하다는데 동의하고 있다.

미국 정부는 섹스팅에 대한 죄를 성인보다 청소년에 좀 더 약화해서 처벌하는 법안 마련에 착수할 예정이다. 현행 법에서는 선정적인 사진을 다른 사람의 휴대전화에 전송하는 행위는 중죄에 해당된다.
