Doctor sentenced to 20 years in prison for murdering wife

A 31-year-old doctor was sentenced to 20 years in prison for strangling his pregnant wife, a Seoul district court said Thursday.

In the first trial of the "Korean OJ Simpson case," the Seoul Western District Court concluded that the doctor, surnamed Baek, strangled his nine-month pregnant wife at their home on Jan. 14.

“There are sufficient reasons to believe that the victim was strangled. All the charges filed by the prosecution are acknowledgeable,” the court said in the ruling. “Still, the murder didn’t appear premeditated.”

The doctor initially reported to police that he found his wife, 29, dead in the bathtub, saying she must have slipped and died. He claimed that a pregnant woman can experience a neck constriction while slipping or falling down, denying murder.

According to the prosecution, the husband was not in contact with his acquaintances for several hours on the day of the murder and there were no signs of outsiders entering the house according to surveillance TVs around the couple's home.

An autopsy report also said the wife likely died from strangulation, not an accidental fall.

서울서부지법 형사12부(한병의 부장판사)는 15일 만삭의 아내를 목 졸라 살해한 혐의(살인)로 구속기소된 백모(31.의사)씨에게 징역 20년을 선고했다. 재판부는 "자신의 아이를 임신해 출산이 한 달 남짓 남은 아내를 목졸라 태아까지 사망에 이르게 해 비난 가능성이 매우 크다"며 "사건 직후 현장을 떠나 범행을 은폐하려 하면서 피해자에 대한 애도를 표하거나 용서를 구하지 않고 자신의 방어에만 몰두한 것으로 보인다"고 밝혔다. 이어 "피고인은 수많은 간접사실과 정황에도 불구하고 합리성이 결여된 변명만으로 일관했다"며 "예민한 상태에서 우발적으로 범행한 것으로 보이고 형사처벌 전력이 없는 점을 고려했다"고 양형 이유를 설명했다. 재판부는 백씨의 아내 박모(29)씨의 사인에 대해 "목 부위의 피부 까짐이나 내부 출혈 등으로 볼 때 목눌림에 의해 사망한 것으로 보이고 피고인 측 주장처럼 이상자세에 의한 질식사라고 보기 어렵다"고 말했다. 쟁점인 사망시각에 대해서는 "오차범위 등을 고려하면 사망추정 시각의 범위에 오전 6시41분 이전과 이후가 모두 포함될 수 있다"며 "제3자의 범행 가능성은 거의 없어 보이고 사건 당일 피고인의 행적과 증인들의 진술 등을 종합해보면 피해자는 백씨가 집을 나간 시점인 오전 6시41분 이전에 액사당했다고 충분히 인정된다"고 밝혔다.
